These Terms and Conditions govern access to the website and purchases made on MEDICUBE EUROPE. By placing an order, the customer confirms that they have read the pre-contractual information, these Terms, and the referenced policies.
1. Seller and Contact Information
The MEDICUBE EUROPE online store is operated by BEAUTY & BEAUTY S.R.L., VAT and Tax ID No. 01026380459, EU VAT No. IT01026380459, REA MS-107045, with headquarters at Corso Vannucci 22, 06121 Perugia (PG), Italy. Email: almeicosmei@gmail.com. Certified email (PEC): beauty-beauty@pec.it.
2. Scope of Application
These Terms apply to consumers and, to the extent compatible, to business customers. The mandatory protections provided for in the Consumer Code and European Union legislation remain fully applicable to consumers.
3. Products and Information
We present product features, images, ingredients, compatibility, and instructions for use with the greatest possible accuracy. Colors, packaging, or graphic details may vary due to updates by the manufacturer without altering the essential features. The information provided on the packaging and in the manual included with the product takes precedence in the event of updates.
Cosmetics and beauty-tech devices are not a substitute for medical diagnoses or treatments. Customers must read the label, warnings, and instructions before use, perform a skin test when indicated, and discontinue use in the event of adverse reactions.
4. Order and Conclusion of the Contract
Submitting an order constitutes an offer to purchase. The contract is concluded when we send the order confirmation, subject to the outcome of the payment and anti-fraud checks. We may refuse or cancel an order—and refund any amount collected—in the event of unavailability, an obvious pricing error, incomplete information, suspected fraud, a violation of these Terms, or inability to deliver.
5. Prices, Taxes, and Promotions
Prices are listed in euros and include VAT and customs duties. There are no additional charges for VAT, duties, or customs clearance upon delivery. Shipping costs and other charges are displayed before checkout. Promotions are valid during the period and under the conditions indicated, while supplies last (if quantities are specified), and may not be combined with other offers. A clearly incorrect price is not binding on the seller; before canceling the order, we will notify the customer and refund the amount paid.
6. Payments
Only the payment methods displayed at checkout are accepted. Payments are processed through Shopify and authorized providers; MEDICUBE EUROPE does not store full payment card information. The customer warrants that they are authorized to use the selected payment method.
7. Shipping and Delivery
Destinations, costs, tracking, and delivery times are describedin the Shipping Information. Orders are shipped from Hong Kong. Order fulfillment takes 1–5 business days, and shipping takes 8–14 business days after dispatch: the estimated total delivery time is 9–19 business days from order confirmation, excluding Saturdays, Sundays, and holidays, unless a different timeframe is communicated prior to purchase or expressly agreed upon.
8. Cancellations, Returns, and Refunds
The consumer may exercise the right of withdrawal within 14 days of delivery, without providing a reason, in accordance with the procedures set forthin the Returns and Refunds Policy. This is without prejudice to the exceptions provided by law, including the exception regarding sealed goods that cannot be returned for hygiene reasons or reasons related to health protection and that have been opened after delivery.
9. Legal Warranty of Conformity
Consumers are covered by the statutory warranty of conformity provided for by applicable law, generally for two years from the date of delivery. If a product is defective or nonconforming, please contact customer service with your order number and any relevant documentation. The remedies provided by law are not limited by any commercial warranties.
10. Proper Use of Devices
The devices must be used strictly in accordance with the manufacturer’s manual and warnings. Do not use on broken or inflamed skin, or if any of the listed contraindications apply. If you are pregnant, have implanted medical devices, have a medical condition, or have any concerns, consult a healthcare professional before use. MEDICUBE EUROPE is not liable for any damages resulting from use contrary to the instructions, except as required by law.
11. Intellectual Property
The text, trademarks, logos, photographs, videos, graphics, and software on this website are protected by applicable laws and belong to their respective owners or are used with permission. You may not copy, distribute, or commercially exploit them without permission.
12. Prohibited Conduct
It is prohibited to use the site for unlawful purposes, attempt unauthorized access, interfere with its security or operation, introduce malicious code, collect data from other users, or place fraudulent orders.
13. Third-Party Services and Links
The website may integrate third-party services, including Shopify, payment processors, and multimedia tools. These services may be subject to their own terms and conditions and privacy policies. We are not responsible for external content over which we have no control, except as required by law.
14. Liability
No provision excludes or limits liability in cases where such exclusion or limitation is prohibited by law, nor does it limit the consumer’s mandatory rights. To the extent permitted, we are not liable for temporary interruptions, events beyond our reasonable control, or damages caused by misuse of the products.
15. Governing Law and Disputes
These Terms are governed by Italian law, without prejudice to the mandatory provisions of the consumer’s country of residence. For disputes with consumers, the court of the consumer’s place of residence or domicile has jurisdiction, where provided by law. Before initiating a dispute, we invite you to contact us to attempt an amicable resolution.
16. Changes
We may update these Terms for operational or regulatory reasons. The version applicable to each purchase is the one published at the time the order is placed. If any provision is found to be invalid, the remaining provisions will remain in full force and effect.
